Felony Drug Possession

Evidence Suppressed; Case Dismissed

Henderson Law Group represented a 17-year-old Ballwin man on one count of felony drug possession in St. Louis City Circuit Court. The lead detective noted that a hotel employee found large amounts of narcotics in a room that was rented out to an individual and that when the detective arrived at the hotel he encountered the individual and our client trying to regain access to the hotel room. The detective questioned them and noted that our client’s friend told the detective he had marijuana on him. The detective then placed out client and our client’s friend under arrest. Our client was searched and heroin was found on his person. We filed a Motion to Suppress Evidence and argued that the detective did not have probable cause to put our client under arrest and that all the evidence should subsequently be suppressed. The court agreed with our position and the prosecutor filed a dismissal of the immediate after the hearing.
