Evidence suppressed; Case Dismissed

Henderson Law Group represented a Jefferson County man charged with Felony Possession of Marijuana. Our client was pulled over in his vehicle for allegedly crossing the fog line one time and then subsequently admitted to smoking pot and gave the police officer consent to search his vehicle. As a result of the search, the police officer found marijuana. Henderson Law Group filed a motion to suppress the drug evidence due to an unconstitutional and illegal stop. We argued that our client’s consent to search his vehicle was not valid because our client was illegally stopped and seized. The judge agreed with our position and ruled that the marijuana could not be used as evidence at trial. Case Dismissed.
