Jefferson County, MO Statutory Sodomy Attorney

If you or a loved one is under investigation for statutory sodomy or have been charged with statutory sodomy in Missouri, it is imperative that you seek out an experienced and aggressive St. Louis, Missouri lawyer at the earliest possible stage of the investigation. At Henderson Law Group, our St. Louis attorneys can fight for you.

1st Degree vs. 2nd Degree

In Missouri, there are two degrees of statutory sodomy. Statutory sodomy in the first degree occurs when an individual has “deviate sexual intercourse with another person who is less than fourteen years old.” The only distinction between statutory sodomy in the first degree and statutory sodomy in the second degree is the age of the alleged victim. Statutory sodomy in the second degree is applicable when the alleged victim is older than thirteen years of age.

Penalties in Missouri

Statutory sodomy in the first degree carries with it a sentencing range of up to life imprisonment with a minimum term of imprisonment of five years. Statutory sodomy in the second degree is considered a class D felony and carries a sentencing range of up to seven years in prison.

Needless to say, if you are facing a possible charge for statutory sodomy in either the 1st degree or 2nd degree, the consequences can be devastating. Not only is your freedom at stake but also other consequences are possible such as residential restrictions, registration as a sex offender, and the stigma of a sex offense being made part of your permanent record.
