A Missouri MIP and the Abuse and Lose Law

A Missouri MIP and the Abuse and Lose Law

A Missouri MIP (minor in possession) may not seem like a big deal, but it can have several negative consequences. Under Missouri’s Abuse and Lose Law, courts are required to suspend or revoke the driving privileges of any person who is “determined to have committed the offense” of Minor in Possession in violation of RSMo 311.325.

A plea of guilty, plea of nolo contendere, finding of guilt, or conviction of a MIP offense will trigger the automatic suspension of driving privileges. For a first offense MIP, the suspension will be for a period of 90 days. For a second MIP offense, the suspension will be for 1 year. All subsequent MIP offenses after the second offense will trigger a 1 year suspension.

With the possibility of jail, steep fines, and suspension of driving privileges, it is critical that if you or a loved one is charged with a Missouri MIP you immediately seek out an experienced and aggressive St. Louis MIP lawyer.
