Strange News: Do 4th Amendment Rights Apply After Death?

In Largo, Florida, a thirty-year old man, Linus Phillip, was killed by a police officer in March 2018 after authorities said he drove away before the officer could search him. As part of their investigation, two Largo detectives went to the funeral home where Phillip was being kept. They used his hand to try and unlock his phone using the fingerprint sensor, but failed. Family members have since raised concerns about violation and disrespect. The 4th Amendment cannot be asserted once you are dead; however, had his family inherited his phone? If so, they 4th Amendment may apply.
